One-on-One Fitness Training (Offline)
1. SERVICES PROVIDED
Trainer agrees to provide fitness training services as per the agreed-upon schedule, either in person or virtually, designed to assist the Client in reaching their fitness goals. Trainer makes no guarantee of specific results and acknowledges that success in achieving fitness goals depends on individual effort and adherence to the training plan.
2. MEDICAL DISCLAIMER
Client agrees that they are in good physical condition and have no medical condition or impairment that would prevent participation in physical activities. The Client is advised to consult a physician prior to beginning any fitness program. The Client assumes all risks related to fitness training and releases the Trainer from any liability for any injury, illness, or condition that arises during or after participation in training sessions.
3. ASSUMPTION OF RISK
Client understands that participation in physical fitness activities involves inherent risks, including, but not limited to, muscle strains, sprains, and more serious injuries such as heart attacks or other medical conditions. The Client voluntarily assumes all such risks associated with participation in fitness training.
4. LIABILITY WAIVER
The Client agrees to waive any and all claims or demands of any kind related to fitness training against the Trainer, including those arising from negligence, to the fullest extent permitted by law. The Trainer shall not be liable for any injury, loss, or damage to the Client’s person or property arising from, or in connection with, any service provided by the Trainer.
5. PAYMENT TERMS
– Payment Process: Payments for services must be made prior to the beginning of each training session or as per the agreed-upon package. Payment methods may include bank transfer, UPI, PayPal, or other online payment gateways.
– Late Payment: Any late or failed payment may result in suspension or termination of training services.
– No refunds will be given for missed sessions.
6. CANCELLATION or RESCHEDULING OF SESSION
– If the Client needs to cancel/reschedule a session, 24 to 48 hours notice is required. Failure to provide adequate notice will result in the session being charged in full.
– If the Trainer needs to cancel/reschedule a session, reasonable efforts will be made to offer an alternative session time.
7. CONFIDENTIALITY
The Trainer agrees to keep any personal, health, or fitness information provided by the Client confidential. The Client’s information will not be shared with third parties unless required by law.
8. TERMINATION
Either party may terminate this agreement with 5 working days’ written notice. If the Client chooses to terminate training services, they agree to settle any outstanding payments due at the time of termination.
– If termination is initiated by the Client, no refund will be provided. The reason for termination will be judged and scrutinized by the management. If the concern is valid then the client will be provided with an option to change the trainer. If the concern or allegation is invalid, then the client’s membership is terminated by FITSTT.
– The Trainer reserves the right to terminate the program if the Client exhibits inappropriate or unsafe behavior.
9. LATE ARRIVALS
If the Client is late for a session, the session will still end at the originally scheduled time. If the Trainer is late, additional time will be added to the session, or a mutually agreed-upon adjustment will be made.
10. IMAGE AND VIDEO RELEASE
The Client grants permission to the Trainer to take photos and videos during training sessions for use in marketing materials, including social media, unless the Client expressly opts out in writing.
11. INDEPENDENT CONTRACTOR STATUS
The Trainer is an independent contractor and not an employee of the Client. The Trainer retains the right to provide services to other clients.
12. ENTIRE AGREEMENT
This document constitutes the entire agreement between the Client and the Trainer. Any modifications to this agreement must be made in writing and signed by both parties and management.
13. GOVERNING LAW
This agreement shall be governed by and construed in accordance with the laws of India

– Platform Usage: Classes will be held on a specific online platform (e.g., Zoom, Skype, or Google Meet). Participants must ensure they have the correct platform installed and functioning prior to class.
– Class Link: The link to access the class will be shared before the session. It is for the registered participant only and should not be shared with others.

Kids’ Fitness Personal Training Program
1. ELIGIBILITY
Participants must be aged between 6 and 16 years. A parent or legal guardian must provide consent.
2. HEALTH AND MEDICAL CONDITIONS
– It is the responsibility of the parent/guardian to disclose any pre-existing medical conditions, injuries, or illnesses of the child before starting the training program.
– The parent/guardian must provide medical clearance if required by the Trainer.
– The Trainer reserves the right to terminate the program if health concerns arise that may pose a risk to the child’s safety.
3. TRAINING SESSIONS
– Sessions will be scheduled at a mutually agreed upon time between the Trainer and parent/guardian.
– The duration of each session will be 45 minutes.
– Parents/guardians are responsible for ensuring the child is available on time for each session.
– Parents/guardians must be present during the period of entire session

– The Trainer reserves the right to terminate the program if the child exhibits inappropriate or unsafe behavior.
7. PARENTS/GUARDIAN RESPONSIBILITIES
– Parents/guardians must supervise their child outside of the training sessions, ensuring that the child follows any recommendations provided by the Trainer.
– Any concerns or complaints about the training should be discussed directly with the Trainer or Customer Service.
8. LIABILITY WAIVER
– The parent/guardian acknowledges that participation in physical activity carries some risks, including but not limited to injury, and assumes full responsibility for any injuries or health issues that may occur.
– The Trainer is not liable for any injury, loss, or damage that may result from participation, except where caused by negligence.
9. TERMINATION

– Copyright: All session/class materials are the intellectual property of the instructor and should not be used or distributed without permission.
– Non-Commercial Use: Participants are not allowed to use the learned material for commercial purposes without authorization from the instructor.

Dietitian
1. DIETITIAN RESPONSIBILITIES
The dietitian will provide nutritional guidance and meal planning but will not diagnose medical conditions.
2. CLIENT RESPONSIBILITIES
Clients must provide accurate medical information, follow recommendations, and notify the dietitian of any health changes.
3. CONFIDENTIALITY AND PRIVACY
All personal health data provided by the client will be kept confidential and handled in compliance with data protection laws (e.g., GDPR, HIPAA).
4.CONSENT FOR SHARING INFORMATION
If necessary, client information will be shared with doctors or family members only after obtaining consent for the same from the client.
5. HEALTH DISCLAIMER
The advice provided by the dietitian is not intended as a substitute for medical advice, diagnosis, or treatment.
6. RESULTS DISCLAIMER
The Dietitian makes no guarantee of specific results and acknowledges that success in achieving fitness goals depends on individual effort and adherence to the diet plan.
NON-REFUNDABLE POLICY
At FITSTT we are committed to providing exceptional service and value. Please note that all plans and memberships purchased are non-refundable. This policy is applicable to all types of plans, including subscription plans, one-time services, and packages.
However, if you are unable to use your membership, you may transfer it to a blood relation or a family member. To initiate a transfer, please contact our customer service team with the details of the intended recipient. All transfers must be completed in accordance with our transfer procedures.
